Terms of Service

Welcome to WaterFall Design. These Terms of Service govern your access to and use of the platform, including all websites, applications, services, messaging systems, and booking tools provided by WaterFall Design (the “Platform”).

By accessing or using the Platform, you agree to comply with and be legally bound by these Terms.

If you do not agree to these Terms, you may not use the Platform.

1. Nature of the Platform

WaterFall Design operates as a private online marketplace that connects property owners (“Hosts”) with invited or approved individuals seeking accommodations (“Guests”).

The Platform facilitates communication and booking requests between Hosts and Guests but does not own, control, manage, or operate any properties listed on the Platform.

Hosts are solely responsible for their listings and accommodations.

2. Eligibility and Accounts

Use of the Platform is restricted to individuals who:

  • are at least 18 years of age

  • have created an approved user account

  • comply with all applicable laws

The Platform may operate on an invite-only or approval basis, and the Platform reserves the right to approve, suspend, or terminate accounts at its discretion.

Users are responsible for maintaining the confidentiality of their login credentials.

3. Listings and Host Responsibilities

Hosts who create property listings represent and warrant that:

  • they have the legal right to rent the property

  • the listing information is accurate and complete

  • the property complies with applicable laws and regulations

  • they have obtained any required permits or licenses

Hosts are solely responsible for:

  • property safety

  • cleanliness

  • compliance with local short-term rental regulations

  • insurance coverage for their property

The Platform does not inspect or guarantee the quality or safety of any listing.

4. Booking Requests and Confirmations

Guests may submit booking requests through the Platform.

A booking is considered confirmed only when:

  • the Host accepts the booking request, and

  • any required payment arrangements are completed.

Hosts retain the right to accept or decline booking requests.

5. Payments

Payments may be processed through third-party payment processors assigned to this platform.

The Platform may facilitate payment transactions but is not a financial institution and does not hold funds as a bank.

Payment processing services may be provided by external providers such as Stripe or similar services.

Users agree to comply with the terms of any payment processor used by the Platform.

6. Platform Fees

The Platform may charge service fees, booking fees, or other charges to Hosts or Guests.

Any applicable fees will be disclosed prior to completing a transaction.

7. Messaging and Communications

The Platform includes a messaging system that allows Hosts and Guests to communicate.

Users agree to use the messaging system respectfully and may not use it to:

  • harass or threaten others

  • send spam or fraudulent communications

  • attempt to bypass platform policies

The Platform may monitor or review communications when necessary for safety, fraud prevention, or dispute resolution.

8. Cancellations

Cancellation policies may vary by listing.

Hosts are responsible for defining their cancellation policies in their listings.

Guests should review cancellation policies before submitting a booking request.

9. User Conduct

Users agree not to:

  • engage in fraudulent or deceptive activity

  • misuse the Platform

  • interfere with the operation of the Platform

  • scrape, copy, or reproduce Platform content without permission

The Platform may suspend or terminate accounts that violate these rules.

10. Intellectual Property

All software, design, branding, and content of the Platform are the intellectual property of WaterFall Design and are protected by copyright and intellectual property laws.

Users may not copy, reproduce, modify, distribute, or create derivative works based on the Platform without written permission.

11. Limitation of Liability

The Platform acts solely as a marketplace connecting Hosts and Guests.

The Platform is not responsible for:

  • property conditions

  • host or guest conduct

  • damages occurring during a stay

  • disputes between users

Users assume responsibility for their interactions and transactions.

12. Termination

The Platform may suspend or terminate user accounts for violations of these Terms or for any reason deemed necessary to protect the integrity of the Platform.

13. Governing Law

These Terms are governed by the laws of BC, Canada without regard to conflict-of-law principles.

**** This platform operates as a private network. Access may be restricted, revoked, or limited at the discretion of the platform to maintain community standards and safety.
